1. Agreement and Scope
These Terms of Use and Sale (“Terms”) are an agreement between you and Essentrx (“Essentrx,” “we,” “us,” or “our”). They apply to essentrx.com, related storefront pages, accounts, purchases, customer support, and other services that link to these Terms (collectively, the “Services”). Our Privacy Policy, Shipping Policy, Returns & Exchanges Policy, and, when applicable, Membership Terms are incorporated by reference.
If you do not agree, do not use the Services or place an order. Additional terms shown with a promotion, product, or feature also apply to that offering. If those additional terms conflict with these Terms, the more specific terms control for that offering.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter a binding contract to make a purchase or start a membership. The Services are not directed to children under 13.
You agree to provide accurate, current information and to keep your account credentials confidential. You are responsible for activity under your account unless caused by our failure to use reasonable security. Tell us promptly at support@essentrx.com if you suspect unauthorized access. We may suspend or close an account when reasonably necessary to protect customers, prevent fraud, comply with law, or address a material violation of these Terms.
3. Products, Scent Descriptions, and Safe Use
We try to describe products, colors, packaging, notes, sizes, availability, and prices accurately. Screen settings, natural variation, reformulation, and packaging updates can affect appearance or scent. Descriptions and quiz results are informational preferences, not medical advice or a guarantee that a product will suit you.
Review the product label and ingredient information before use. Follow all directions and warnings. Avoid eyes, ingestion, flame, and use on broken or irritated skin. Ingredient sensitivities vary; discontinue use if irritation occurs and seek appropriate medical advice. If you have allergies, sensitivities, pregnancy-related concerns, or another medical condition, consult a qualified professional before use.
References to designer fragrances identify scent inspiration or comparison only. Essentrx is not affiliated with, endorsed by, or licensed by the owners of referenced brands unless a page expressly says otherwise.
4. Orders, Prices, and Payment
Your order is an offer to buy. We may accept, reject, limit, or cancel an order for legitimate reasons such as unavailability, pricing or description errors, suspected fraud, payment failure, shipping restrictions, or legal requirements. An automated confirmation means we received the order; acceptance occurs when we charge the approved payment method or begin fulfillment. If we cancel after payment, we will issue the required refund.
Prices are shown in the currency identified at checkout and may change prospectively. Taxes, shipping, duties, currency conversion fees, and other charges are shown or calculated as applicable before completion. You authorize us and our payment providers to charge the amount displayed at checkout. You represent that you are authorized to use the selected payment method.
We may correct an obvious pricing or typographical error before shipment and will give you the choice to accept the corrected price or cancel when required. Promotional codes have no cash value, may have eligibility and expiration rules, cannot be combined unless stated, and may be withdrawn or corrected if used fraudulently or contrary to their terms.
5. Shipping, Delivery, Returns, and Exchanges
Available destinations, rates, processing estimates, and delivery terms are in our Shipping Policy. Delivery dates are estimates unless we expressly promise a specific date. Risk of loss and title pass as provided by applicable law and the selected delivery arrangement.
Our Returns & Exchanges Policy explains the 15-day scent trial, eligibility, and remedies. That policy does not limit rights that cannot legally be waived, including remedies that may apply to damaged, defective, incorrect, nonconforming, or materially delayed goods.
6. Memberships and Automatic Renewal
Memberships renew automatically and create recurring charges until canceled. The price, billing frequency, renewal terms, included shipping, cancellation method, and other material details appear immediately before enrollment and in the Membership Terms. You must affirmatively accept those terms before joining. Cancel online through Account > Cancel Membership before the next billing date to avoid the next charge.
7. Email, Text Messages, and Electronic Records
We may send transactional communications needed to service your account, purchase, delivery, or membership. Marketing email or text messages are optional. Where you opt in to recurring automated promotional texts, message frequency varies and message and data rates may apply. Consent is not a condition of purchase. Reply STOP to stop promotional texts or HELP for help. Carriers are not liable for delayed or undelivered messages.
You consent to receive agreements, notices, and records electronically. You may retain them by printing or saving. You are responsible for keeping your email address and phone number current.
8. Acceptable Use and User Content
You may use the Services only for lawful, personal, noncommercial shopping and account purposes. You may not interfere with security or operation; access another person’s account; scrape, crawl, reverse engineer, or automate access except as allowed by law or our written permission; submit malicious code; evade limits; misuse promotions; infringe rights; or use the Services for fraudulent or unlawful activity.
If you submit a review, image, message, suggestion, or other content, you retain ownership but grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, adapt, and use it to operate, improve, and promote the Services, subject to our Privacy Policy. You represent that you have the rights needed to submit it and that it is accurate and lawful. We may moderate or remove content for legitimate legal, safety, or service reasons.
9. Intellectual Property and Third-Party Services
The Services and their original text, design, software, graphics, logos, and other content are owned by Essentrx or its licensors and protected by applicable law. We give you a limited, revocable, nontransferable right to use the Services for their intended purpose. No other license is granted.
The Services may use or link to third-party services such as payment, shipping, support, analytics, and social platforms. Their separate terms and privacy practices apply to their services. We are not responsible for third-party sites we do not control, but nothing here limits responsibility we have under applicable law for vendors acting on our behalf.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement to the extent those warranties may legally be disclaimed. We do not promise uninterrupted or error-free operation, that every scent will meet subjective preferences, or that third-party services will always be available.
Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the extent permitted, and any legally required warranty remains in effect.
11. Limits of Liability
To the fullest extent permitted by law, Essentrx will not be liable for indirect, incidental, special, exemplary, or consequential damages, or lost profits or data, arising from the Services. To the fullest extent permitted by law, our aggregate liability for a claim relating to a purchase will not exceed the amount you paid for the product or service giving rise to the claim.
These limits do not apply where prohibited, including liability that cannot be limited for death or personal injury, fraud or fraudulent misrepresentation, willful misconduct, gross negligence, violation of mandatory consumer rights, or other liability that applicable law does not permit us to exclude or limit.
12. Your Responsibility for Misuse
To the extent permitted by law, you will reimburse Essentrx for reasonable losses, liabilities, and costs resulting from your unlawful misuse of the Services, your infringement of another person’s rights, or content you submit in violation of these Terms. This does not require you to cover losses caused by Essentrx or waive any nonwaivable consumer right.
13. Questions and Disputes
Please contact support@essentrx.com first so we can try to resolve a concern. Include your name, order number, a description of the issue, and the resolution you seek. These Terms do not require private arbitration and do not waive any right to bring an eligible claim in court or use a government consumer-protection process.
The law applicable to a dispute and the available forum are determined by applicable law. Nothing in these Terms deprives you of mandatory protections of the place where you live or where the transaction occurred.
14. Changes and General Terms
We may update these Terms prospectively. We will post the revised version and update the effective date, and we will provide additional notice when required. Material changes to an existing membership are governed by the Membership Terms and applicable notice requirements. Continued use after the effective date means you accept the revised Terms for future use; changes do not retroactively alter completed purchases unless law permits and required consent is obtained.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign your account or these Terms without our consent; we may assign them as part of a legitimate reorganization, financing, or transfer of the business, subject to applicable law and the Privacy Policy.
